The MAP Act provides for the establishment ofstatutory measures, namely statutory levies, control of exports of agricultural products, records & returns, and registration. Once a statutory measure is approved by the Minister, it becomes enforceable and legal action may be taken against those who fail to adhere to the statutory measure that was approved and promulgated. The Statutory Measures Division’s strategic goal is to: - provide the Minister with recommendations regarding the establishment, continuation, amendment or repeal of a statutory measure, - to promulgate statutory measures in the Government Gazette after the Minister approved it, - to ensure that statutory measures comply with MAP Act objectives and NAMC policies and guidelines, and - to monitor the application of statutory levies A statutory levy may be regarded as a “dedicated tax” per unit of an agricultural commodity at any point in the marketing chain between the producer and the consumer, which is collected for a specific purpose such as funding for research, information or transformation. Registration is a statutory measure implemented in some agricultural sectors for the purpose of building a database of industry role players such as producers and processors, and records & returns are implemented for the collection and dissemination of generic market information. Furthermore, the Statutory Measures Division conducts an annual review of all statutory measures implemented in terms of the MAP Act. Currently the following statutory measures are applicable: - Registration and Records & Returns (milk, maize, oilseeds, mohair, wool, lucerne, citrus, cotton, dairy, deciduous fruit, dried fruit, potato, pork, red meat, table grapes, sorghum, wine and winter cereal industries); - Levies (citrus, cotton, dairy, deciduous fruit, dried fruit, potato, pork, red meat, table grapes, sorghum, wine and winter cereal industries)
